Home Based Businesses

I get a lot of questions asking about home based businesses,  They are the way to go if you want to make part time income or have something to do until you get working full time again but unless you have deep financial pockets you have to watch what you are doing.

The sobering news is that most businesses started at home fail within 3-5 years.  People start selling multi-level marketing schemes, vitamins, perfumes, cleaning products, you name it-somebody probably has an angle on it.

One of the latest items has been e-cigarettes which were electronic cigarettes from China that allowed you to dial your nictotine consumption and take it flavorfully electronically sparked. People were selling them in kiosks in malls but the FDA got ahold of the news and is shutting them down since the device hasn’t been approved.

These leads into one of my number one issues with people who start up a business at home – do your homework on licenses, taxing regulations and the market.  Three simple things that if done can save you money and horror stories later on.  If you have a requirement for a business license, get it.  In the City of Los Angeles, if you make under $100,000 you can generally get a license for free- if you remember to file timely.  If you are required to collect taxes – make sure you get a resale license from your state taxing authority and take the time to collect whatever you need to from your clients or customers.

These simple tips will also give you insight into your business and keep your actions above board and limit the chances that if you get audited you will be treated as a hobby (and taxed accordingly) instead of a business.

Some home based businesses that may make you some money – credit card or general debt restructure advice, anything that has to do with making money at home, selling organic vegetables.

Rental and Separate Home Whacky Question

I had this interesting question from a reader:”I own a home, separate from that I rent a room elsewhere and I sublet that room.  I pay $600 a month rent but I sublet the room for $550.  Can I deduct the income from the room and show a loss of $50 a month in income?”

My answer is that is a whacky question.  Here is a sober answer though with appropriate whacky answers.  You can’t claim the rental as a business because for taxes, specifically Schedule E purposes, a rental has to consist of more than one room that you are owning.  If you were renting a room in the house you live in, that is a different story. 

You can claim the income on line 21 of your Form 1040 as Other Income and show the rent you pay for the unit on Schedule A as a business expense subject to the 2% of income.  In other words, you really aren’t going to get any benefit for renting your room as a sublet at a loss.  From a business point-of-view, it doesn’t make any sense.  Why keep a rental that you are losing money on?  The IRS and respective state tax agencies would agree with my position on this one.

Are you keeping it because of a child who is going to college near by?  Is your girl friend or mistress staying there and are you charging her money?  Are you a couple of saucy gals who are running men in late at night like in this scandalous picture?  If so, for shame!  If it is none of the above, I suggest that you either just do the return the way I show you on an on-going basis or plan on getting out of the sublet business sometime soon in 2009.  Keep those great and whacky tax questions coming.
